Oct. 21, Gerald D. Hager, journal entry of conviction and sentencing. The court sentenced the defendant to a controlling sentence of 60 days in the custody of the Marion County sheriff for Count 2, possession of drug paraphernalia. The court placed the defendant on immediate supervised probation with a Court Services officer for 12 months. Said probation is subject to all standard terms and conditions and the following special terms: the defendant was ordered to serve 48 hours in the county jail for every positive drug/alcohol test, refusal to submit or admission of usage. The court ordered the Court Services officer can request that the defendant complete a drug/alcohol evaluation and follow all recommendations at his own expense. The court ordered the defendant to complete a domestic violence assessment at his own expense and follow all recommendations. The court ordered the defendant to pay court costs of $116, a probation fee of $25 and court appointed attorney fees as determined by the court. The court further ordered the defendant to obey all federal, state and city laws and ordinances.

Oct. 30, Jeff Allen Miller, diversion agreement for one count of domestic battery. The defendant shall not violate any laws of the United States or of any state, or any ordinance of any municipalities. The defendant shall pay a diversion fee of $125, court costs of $158 and a booking fee of $45. All costs and fees were to be paid at the time of filing of this agreement. The defendant shall enroll and successfully complete anger management or batterer intervention program and follow those recommendations for treatment as set forth in the Kansas Attorney General Domestic Violence Offender Assessment and pay all costs associated with said program. This diversion agreement shall terminate within 12 months from the date of the agreement and upon the defendant?s successful completion of the terms and conditions set out. The defendant understands that failure to do so at any time will result in the Marion County Attorney setting the matter for bench trial.

Accidents

At 2 a.m. Oct. 8, Sierra Olivia Smith, 19, Wichita, was driving a 2004 Chevrolet Impala east on U.S. Highway 50 near 70th. Tevin James Johnson, 21, Wichita, and Kylie Deshaun Jackson, 25, Wichita, were passengers in the vehicle. One of the passengers stated the driver and the other passenger were arguing and the driver lost control of the vehicle which went into the north ditch, through a barbed wire fence, and struck trees. The driver and Johnson were taken by LifeTeam Air Ambulance to Wesley Hospital. Jackson was transported to Wesley Hospital by Peabody Ambulance. Sgt. Larry Starkey investigated.

At 7:25 a.m. Oct. 13, Gloria M. Safarik, 24, Junction City, was driving a 2006 Jeep Liberty southbound on U.S. Highway 56/77 with passenger Josef W. Safarik, 26, Junction City. A deer ran out in front of the vehicle from the west ditch. The driver swerved to avoid the deer and went into the west ditch striking a fence and tree. Undersheriff David V. Huntley investigated.

At 9 p.m. Oct. 14, Tylar Lane Brockman, 16, Newton, was driving a 2005 Chevrolet Impala northbound on Kansas Highway 15 near 260th when a cow entered the roadway and was struck by the vehicle. Deputy T. Wilson investigated.

At 4:55 p.m. Oct. 15, Devin Kelly Nolte, 15, Canton, was driving a 2008 Chrysler Town and Country eastbound in the 400 block of 130th near Chisholm Trail. The driver lost control of the vehicle, entered the south ditch and struck a utility pole. She was transported by Marion County Emergency Medical Services to Hillsboro Community Hospital. Deputy M.E. Ottensmeier investigated.

At 7 p.m. Oct. 15, Esther Lynn Richert, 33, Hillsboro, was driving a 2002 Chevrolet Suburban southbound on Indigo, turning west on 100th. The driver stated the brakes did not work properly. The vehicle slid off the roadway, over a culvert and into a ditch on the south side of 100th. Deputy D. McCarty investigated.

At 7:25 a.m. Oct. 16, Steven Miller, 35, Marion, was driving a 2000 Chevrolet 1500 pickup northbound on Remington near 240th. A deer ran out of the east ditch and was struck by the vehicle. Under?sheriff David V. Huntley investigated.

At 7:55 p.m. Oct. 21, Keanosha Nancy Dalke, 22, Junction City, was driving a 2011 Chevrolet Cruz south on U.S. Highway 77 when she hit and killed a deer that came out of the west ditch. Deputy D. McCarty investigated.

At 10:19 p.m. Oct. 21, Kevin W. Brewer, 43, Peabody, was driving a 2004 GMC Denali eastbound on U.S. Highway 56 with passenger Cheryl L. Brewer, 41, Marion. A deer came out of the north ditch and was struck and killed by the vehicle. Deputy D. McCarty investigated.

At 2:53 a.m. Oct. 19, Ashley B. Spencer, 24, Hillsboro, was driving a 2014 Chevrolet Impala east in the 800 block of 190th when the vehicle drifted onto the left shoulder of the roadway, the driver over-corrected and lost control, going into the south ditch, striking a tree and coming to rest in a dry creek bed. William Hickman, 30, Hillsboro, was a passenger in the vehicle. Deputy M.E. Ottensmeier investigated.

At 1:20 a.m. Oct. 23, Shanna Nicole Witt, 19, Junction City, was driving a 2001 Oldsmobile Alero north on U.S. Highway 77 at mile post 88 when she swerved to avoid a deer. The driver lost control of the vehicle and went into the west ditch, disabling the vehicle. Deputy M.E. Ottensmeier investigated.

At 7:01 a.m. Oct. 27, Richard Chumbley Jr., 60, Marion, was driving a 2010 Chrysler Town and Country southbound on Kansas Highway 15 with passenger Barbara Chumbley, 59, Marion. A deer was struck and killed when it ran out in front of the vehicle from the west ditch. Undersheriff David V. Huntley investigated.

At 8:35 p.m. Oct. 27, Louise A. Whiteman, 61, Marion, was driving a 2007 Toyota Sienna northbound in the 1700 block of Nighthawk. A deer ran into the path of the vehicle and was hit. Deputy M.E. Ottensmeier investigated.

At 12:55 a.m. Oct. 28, Malainey Sierra-Ann Woods, 20, Warr Acres, Okla., was driving a 2008 Dodge Caliber northbound on U.S. High?way 56 at mile post 314. The vehicle drifted off the roadway onto the east shoulder. The driver lost control of the vehicle, over-corrected and hit a guard rail. The driver was transported by Marion Emergency Medical Services to St. Luke Hospital. Deputy M.E. Ottensmeier investigated.

At 5 pm. Oct. 29, Derrick N. Davis, 46, Independence, was driving a 1968 John Deere 4020 tractor pulling a fold-up mower north on Pawnee. Gary D. Lewis, 61, Marion, was following him in a 2013 Fiat 500. A third vehicle was between the two. Lewis, thinking the first two were together, went to pass both vehicles. However, the tractor turned left into a driveway and they collided, while the vehicle between went straight and was not involved in the accident. Deputy D. McCarty investigated.

At 7:30 a.m. Oct. 30, Paula Jeanne Frazier-Ash, 72, Marion, was driving a 1997 Chevrolet Suburban westbound on 190th when she struck and killed a deer that came out of the north ditch. Ally Larson, 15, Jacob Kanive, 16, and Vince Vanduska, 19, all of Marion, were passengers in the vehicle. Deputy D. McCarty investigated.

Offenses

Sometime between midnight Oct. 1 and 7 p.m. Oct. 11, six campaign signs, valued at a total of $430, were stolen from Craig Dodd.

Sometime between 4:30 p.m. and 5:30 p.m. Oct. 16, a wallet valued at $30 was stolen from a location on Third Street in Florence. The wallet contained two credit cards, a Social Security card, a bank debit card, a memory card and two insurance cards.

Sometime between noon and 4:20 p.m. Oct. 8, $200 damage was caused to the front door of a residence on U.S. Highway 56, Hills?boro.

Sometime between 8 p.m. Oct. 8 and 6 a.m. Oct. 9, a mailbox valued at $100 was damaged and stolen on Meridian Road, Hesston. The mailbox was later recovered.

Sometime between 9:50 p.m. and 9:54 p.m. Oct. 9, a mailbox valued at $30 was damaged on Alamo Road, Newton.

Sometime between 9:50 p.m. and 9:54 p.m. Oct. 9, a mailbox valued at $50 was damaged on Alamo Road, Newton.

Between 9:30 p.m. and 11:43 p.m. Oct. 9, a suspect was reported as being intoxicated and raising her voice at the occupants of a house in Burns. She was arrested for disorderly conduct.

At 3 p.m. Oct. 11, a burglary was reported to law enforcement. A Cub Cadet 100 and a Cub Cadet International Custom, valued at $1,200 each, were taken from a location on Kansas Highway 15.

At 2:58 p.m. Oct. 17, theft of motor vehicle parts and accessories valued at $150 was reported to law enforcement. The items were taken from a location on Pawnee, Marion.

Sometime between 10 a.m. and 3:20 p.m. Oct. 19, $500 damage was caused to two vehicles, and a beige Buick with Kansas license plate 11AWW valued at $20,000 was taken from a location in Florence.

Sometime between 10 a.m. Oct. 11 and 5 p.m. Oct. 18, a home in Florence was burglarized. Missing items include a purse valued at $5, an aluminum wallet valued at $20, a Social Security card and two birth certificates.

Sometime between 10 p.m. Oct. 26 and 5:56 a.m. Oct. 27, three packages of Pall Mall Blue 100 cigarettes valued at $12 were taken from a home on Church Street in Goessel.

Sometime between 10 p.m. Oct. 26 and 5:56 a.m. Oct. 27, six compact discs valued at $60 were taken from a residence on Church Street in Goessel.

Sometime between 2 p.m. Oct. 25 and 1 p.m. Oct. 27, a mailbox valued at $60 was damaged on 190th, Hillsboro.

Routine work includes traffic enforcement while patrolling city, review cases involving court services, business checks, housing checks, perimeter checks around USD 408 school buildings, patrolling school zones, residential and downtown foot patrol, following up on investigations and reviewing cases with the Marion County attorney.

Sept. 29: Assisted Marion County sheriff?s office with suicidal person. Took vandalism report. Verbal warning for expired license plate tag. Received report of prowler.

Sept. 30: Assisted at St. Luke Hospital regarding suicidal person. Assisted Marion County Jail personnel with disorderly arrestee.

Oct. 1: Served arrest warrants; one for failure to appear in court, and one probation violation. Report of civil child custody case, Wichita.

Oct. 2: Verbal warning on brake lamp. Performed K9 training.

Oct. 3: Walked through Marion Elementary School; spoke with school counselor. Assisted another officer with domestic issue. Cited individual regarding damage to property.

Oct. 4: Cited motorist for parking illegally. Assisted Emergency Medical Services.

Oct. 5: Received call of child going through people?s garages; child had permission. Searched for suspects fleeing and eluding authorities.

Oct. 6: Attempted to contact suspect in vehicle pursuit from previous night. Conducted taser instructor recertification training; online portion.

Oct. 7: Responded to resident?s request for an ambulance. Contin?ued investigation by speaking to witness on elude/fleeing case. Report of harassment filed by county attorney and Court Services. Responded to disturbance between neighbors; everything was OK.

Oct. 8: Responded to fire alarm at Cindy?s Cafe. Motorist received verbal warning for headlight. Received call of parking complaint.

Oct. 9: Report of harassment. Followed up on burglary and theft case.

Oct. 10: Responded to call of rabid skunk; skunk was dispatched at the scene. Motorist issued citation for expired registration. Investi?gated call of prescription medications being stolen.

Oct. 11: After checking buildings in Industrial Park, discovered east water tower draining; water department called.

Oct. 11: Assisted Marion EMS with person who fell. Responded to domestic disturbance; talked with both people and separated them. Report of individual bit by a dog; owner given citation; dog placed at Animal Health Center. Assisted Marion County sheriff?s office with possible drunk driver.

Oct. 12: Responded to report of suspicious injury to a child at St. Luke; follow-up interviews revealed no foul play. Assisted Marion EMS with individual who fell. Took report of stolen property located outside city limits; information passed on to Marion County sheriff?s office. Patrolled town, park near banks after city lost power because of downed power line. Received complaint of domestic violence; verbal argument not physical. Conducted K9 indication drills.
