ORDINANCE NO. 1117
AN ODRINANCE REZONING A PARCEL OF PROPERTY FROM A (AGRICULTURAL) TO RL (LOW DENSITY RESIDENTIAL) AS PROVIDED FOR BY 24-1.01 OF THE ZONING REGULATIONS FOR THE CITY OF HILLSBORO, KANSAS.
WHEREAS, under K.S.A.12-741 et. seq. a city is authorized to amend an adopted zoning ordinance; and
WHEREAS, the Governing Body of the City of Hillsboro, Kansas established a community planning and development commission for Hillsboro; and
WHEREAS, the community planning and development commission adopted a zoning ordinance after publication in the official city newspaper at a public hearing on January 8, 1996; and
WHEREAS, the Governing Body approved and adopted the Zoning Regulations on February 20, 1996 through the passage of ordinance no. 945; and
WHEREAS, the community planning and development commission, by a vote of all members present on October 27, 2005, recommended to the Governing Body that the below described parcel be rezoned from the A (Agricultural) zoning district to the RL (Low Density Residential) zoning district as provided for by Section 24-6.01 of the Zoning Regulations; and
WHEREAS, the community planning and development commission has sent a certified copy of such amendment together with a written summary of the public hearing to the Governing Body; and
WHEREAS, the Governing Body of the City of Hillsboro, Kansas wishes to rezone the below described parcel as recommended by the community planning and development commission:
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF HILLSBORO, KANSAS:
Section 1. The land legally described as follows shall be zoned as RL ( Low Density Residential):
A tract of land lying in the Southeast Quarter, Section 34, Township 19 South, Range 2 East of the 6th Principal Meridian, Hillsboro, Marion County, Kansas; said tract being more particularly described as follows: Commencing at the Southeast corner of said Southeast Quarter, thence along the East line of said Southeast Quarter on a Kansas Coordinate System 1983 Grid Bearing of N00 degrees 42’07″W, 637.40 feet; thence S89 degrees 04’47″W, 380.00 feet to the Point of Beginning, thence continuing S89 degrees 04’47″W, 309.39 feet to the Northeast most corner of Prairie Pointe Unit 1, an addition to the City of Hillsboro, Kansas; thence along the North line of said Prairie Pointe Unit 1 addition, S89 degrees 04’47″W, 540.08 feet to the Northwest corner of Lot 18, aforesaid addition, thence S89 degrees 04’47″W, 60.00 feet to the Northeast corner of Lot 19, aforesaid addition; thence S89 degrees 04’47″W, 322.05 feet to the Northwest most corner aforesaid addition, said corner being coincident with the East line of Dahl’s Centennial Addition to the City of Hillsboro, Kansas, thence along said East line of said Dahl’s Centennial Addition, N00 degrees 35’32″W, 857.17 feet to a point lying 25 feet North of the centerline of “A” Street; thence parallel with and 25 feet North of said centerline extended N89 degrees 03’28″E, 48.33 feet; thence N00 degrees 57’23″W, 5.00 feet; thence parallel with and 30 feet North of said centerline extended, N89 degrees 03’28″E, 281.71 feet; thence S00 degrees 35’32″E, 205.00 feet; thence N89 degrees 03’28″E, 328.98 feet; thence S59 degrees 12’00″E, 174.83 feet; thence S45 degrees 42’07″E, 597.09 feet, thence S00 degrees 42’07″E, 141.68 feet to the point of beginning. Said tract contains: 741,398 square feet or 17.02 acres of land, more or less. Generally located at: The unimproved area immediately north of the Prairie Pointe Subdivision.
Section 2. Invalidity of a Part. Any provisions of this Ordinance which shall be declared to be unconstitutional or otherwise invalid shall not affect the validity and authority of any other section of said Ordinance.
Section 3. Effective Date. This ordinance shall take effect from and after its passage, approval and publication once in the official city newspaper.
