RESOLUTION NUMBER 2005-12

A RESOLUTION APPROVING A CONDITIONAL USE FOR A DOG BREEDING KENNEL ON PROPERTY LOCATED IN PT. OF E/2 OF SW/4 OF SECTION 27, TOWNSHIP 19 SOUTH, RANGE 1 EAST OF THE 6th PM, OF PATRICK & JENNIFER MARTIN.

WHEREAS, a public notice of above said proposed conditional use was properly given including publication in the official County newspaper of a public hearing.

WHEREAS, on the 26th of May, 2005, the Marion County Planning Commission did hold a public hearing to consider the above said proposed conditional use.

WHEREAS, the Marion County Planning Commission has recommended approval of a conditional use permit for a dog breeding kennel.

WHEREAS, the Marion County Planning Commission has recommended approval with the condition that there are not to be more than 120 dogs on site at any time.

WHEREAS, the Marion County Planning Commission has recommended approval with the condition that all waste from dogs be handled as special separate waste, by permit by state or county.

WHEREAS, the Marion County Planning Commission has recommended that the owner maintain all necessary USDA, KAHD and State of Kansas licenses for a breeding kennel.

WHEREAS, the Marion County Planning Commissions has recommended that the pens or open kennels be located at least 50 feet from the front lot line and at least 30 feet from any side or rear lot line.

NOW THEREFORE BE IT RESOLVED that a conditional use is hereby approved for a dog-breeding kennel as presented for the following described property:

Pt of the East 1/2 of the Southwest 1/4 of section 27, Township 19 South, Range 1 East of the 6th P.M., described as follows:

Beginning at a point on the East line of the East 1/2 of the Southwest 1/4 of said section 27, 544.16 feet South of the Northeast corner of the East 1/2 of said Southwest 1/4; thence with assumed bearings, West 547.18 feet, thence South 547.18 feet, thence East 547.18 feet, thence North along the East line of said Southwest 1/4 to the point of beginning.

BE IT FURTHER RESOLVED, that a conditional use is hereby directed that the Marion County Zoning district maps be amended to reflect above said conditional use.

This Resolution is made by the Board of Marion County Commissioners this 20th day of June, 2005.
