Lawsuit contends public-private ownership of property between USD 410 and Tabor College is illegal USD 410 patron files lawsuit to prevent bond sale

 

Attorneys acting on the initiative of Hillsboro resident Raymond Brandt filed a lawsuit Monday, June 4, in the Eighth Judical District Court to prevent the sale of $6.625 million in bonds approved by voters in the June 5 election for the purpose of capital improvements.

Specifically, the suit highlights the $2.016 million in bonds to be used for the construction of a new athletic complex in partnership with Tabor College.

The lawsuit contends that the plan for publicly funded USD 410 and privately funded Tabor College to hold joint ownership of property is illegal because the district “is not authorized by law to acquire an undivided joint interest” with a private entity.

The USD 410 Board of Educa­tion has called a special meeting for 8:30 p.m. Tuesday, June 12, to discuss its response to the lawsuit with legal counsel, but Superintendent Gordon Mohn said Friday the district’s attorneys researched the issue thoroughly before preceeding the the strategy, and are confident of the district’s standing.
