Legal counsel representing Raymond Brandt has filed an appeal regarding the summary judgment issued last month against the lawsuit he filed against Unified School District 410.
The appeal was filed Sept. 16, according district officials.
The original suit challenged the co-ownership of a proposed new football and track facility between the district and Tabor College. District Court Judge Steven Hornbaker ruled Aug. 19 that “there were no factual issues to be decided and the case is ripe for summary judgment” in favor of the district’s position.
Superintendent Doug Huxman said he had not yet met with the district’s legal counsel to determine the implication of the appeal or an estimated timetable for its resolution.
“We still think we made the right decision and we’re going to pursue it from that avenue,” Huxman said.
